Your Instagram Account Has Been Blocked: What Should You Do Next?
Having your Instagram account suspended or disabled can mean much more than simply losing access to a social network. Recovering an Instagram account in these circumstances is not only a challenge but can become a serious problem. For many users, it means losing access to family photographs, private conversations, contacts, posts and even information of professional or economic value.
In recent years, we have seen a growing number of enquiries from users who, after exhausting Meta’s appeal procedures, wonder what options they actually have to regain access to their accounts. In this article, we analyse the available evidence, the impact of the Digital Services Act (DSA), and what expectations are realistic.
Can I recover my blocked Instagram account?
The short answer is yes, but there is no procedure that guarantees success.
Experience shows that some suspended or disabled Instagram accounts are eventually restored by Meta. However, there are also many cases in which, despite submitting appeals and providing all the requested documentation, users are unable to regain access.
Every case depends on multiple factors, including the reason for the suspension, the information provided by the platform, the available evidence and the steps already taken by the user.
There are no official statistics on the success rate of these claims
One of the main difficulties is the lack of publicly available information.
Meta does not publish specific figures on the percentage of suspended Instagram accounts that are ultimately restored following an appeal.
Although the Digital Services Act has increased transparency obligations for very large online platforms, the published reports only contain aggregated data. As a result, they do not reveal how many appeals relating to Instagram account suspensions end in favour of the user.
Consequently, it is currently impossible to determine, based on official data, the likelihood of recovering a suspended Instagram account.
What evidence is available?
The available evidence comes mainly from:
- transparency reports published by the platforms themselves;
- academic research;
- administrative and judicial decisions;
- cases documented by the media.
Taken together, these sources support a cautious conclusion: recovering a blocked Instagram account is possible, but it depends on the specific circumstances of each case and cannot be guaranteed.
There are also documented cases in which Meta restored previously suspended accounts following legal action or an individual review. These precedents are relevant, but they do not establish a general rule applicable to every situation.
A recent study questions the transparency of Instagram’s moderation system
Particularly noteworthy is the academic paper From Reports to Reality: Testing Consistency in Instagram’s Digital Services Act Compliance Data, published in July 2025.
The researchers examined the public information Instagram provides to comply with the transparency obligations imposed by the DSA and identified several inconsistencies between different reporting sources.
According to the study, these inconsistencies make it difficult to independently verify how certain moderation decisions are made and how they are subsequently reflected in transparency reports.
The study does not conclude that Meta systematically breaches the law, nor does it analyse individual disputes. However, it highlights an important issue: it is currently difficult to reconstruct the decision-making process behind a specific account suspension.
These findings should be understood in the broader context of increasing regulatory scrutiny of large digital platforms by European institutions. In this regard, we have previously analysed on our blog the legal implications of regulatory decisions affecting Meta in the field of data protection and their impact on both individuals and organisations.
Can legal action improve the chances of recovering an account?
No lawyer can guarantee that a suspended Instagram account will be restored.
Nevertheless, practical experience shows that legal assistance may be useful to:
- objectively assess the merits of the case;
- identify potential breaches of the DSA, the General Data Protection Regulation (GDPR), or the applicable contractual framework;
- submit a properly reasoned legal claim;
- request an individual review of the platform’s decision;
- prepare, where appropriate, for judicial proceedings.
In addition, several documented cases show that some accounts have been restored following the intervention of legal representatives. This does not mean that legal assistance guarantees a positive outcome, but it may increase the likelihood that the case receives human review instead of remaining entirely within automated decision-making processes.
Can I claim compensation if my Instagram account has been blocked?
In some cases, having an Instagram account blocked may cause significant harm, particularly where the user loses access to photographs, videos, conversations or professionally valuable information.
From a legal perspective, it cannot be ruled out that compensation may be available where all the legal requirements for claiming damages are met. However, these claims require evidence of actual loss, the extent of that loss, and a causal link between the platform’s conduct and the damage suffered.
As we explain in our article on compensation for GDPR infringements, entitlement to financial compensation requires an individual assessment of the circumstances of each case and the available evidence.
It should also be borne in mind that this type of claim is generally more complex than an action aimed solely at recovering access to the account. Proceedings are often longer, more expensive and involve greater legal uncertainty due to the limited number of judicial precedents currently available.
For this reason, in many cases it is advisable to focus first on recovering access to the account before considering a separate claim for damages.
The importance of an individual legal assessment
Not every account suspension is the same.
There is a significant difference between an account compromised through unauthorised access and one suspended for an alleged breach of Instagram’s Community Standards or following an automated moderation decision later confirmed by the platform.
For this reason, any assessment of the prospects of success should be based on a detailed review of the available documentation, the communications received from Meta and the steps already taken by the user.
Conclusion
Having an Instagram account blocked may have significant personal and, in some cases, financial consequences.
The available evidence suggests that recovering a suspended Instagram account is possible, but it cannot be guaranteed. The absence of official statistics, the limited number of judicial precedents and the lack of transparency surrounding moderation processes all point to the need for realistic expectations.
At the same time, the Digital Services Act is strengthening oversight of large digital platforms and providing users with new legal tools to protect their rights.
Where a suspension affects personal or professionally important information, obtaining an individual legal assessment is advisable in order to determine the most appropriate strategy in light of the specific circumstances of the case.
