With this date, the <strong>European Union Artificial Intelligence Act (AI Act)<\/strong> enters its general phase of application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But what does this date actually mean for companies?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The short answer is: <strong>it is now time to move from theory to practice<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regulation (EU) 2024\/1689 establishes a risk-based framework for regulating the use of artificial intelligence in the European Union. Although some of its obligations have already applied \u2014 such as those relating to certain prohibited AI practices and AI literacy since February 2025 \u2014 2 August 2026 marks a particularly important milestone in the implementation of the Regulation.<\/p>\n\n\n\n<h2 id=\"h-what-has-changed-on-2-august-2026\" class=\"wp-block-heading\">What has changed on 2 August 2026?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From this date, the European Commission and the competent national authorities begin to apply and enforce the AI Act rules entering their general phase of application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the particularly relevant aspects is the <strong>transparency obligations under Article 50<\/strong>, which apply from 2 August 2026 to certain AI systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These obligations cover, among others, certain generative and interactive AI systems and certain content generated or manipulated artificially.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, in certain circumstances:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>people must be informed when they are directly interacting with an AI system;<\/li>\n\n\n\n<li>certain content generated or manipulated using AI must be marked in a way that makes it identifiable;<\/li>\n\n\n\n<li>deepfakes and certain artificially generated or manipulated content are subject to specific transparency requirements.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The European Commission has also published <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/library\/guidelines-transparency-obligations-providers-and-deployers-ai-systems?utm_source\">specific guidelines<\/a> to help companies and other regulated entities interpret and implement these obligations.<\/p>\n\n\n\n<h2 id=\"h-but-the-important-question-is-what-should-my-company-do-now\" class=\"wp-block-heading\">But the important question is: what should my company do now?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The application of the Regulation does not mean that all companies have to stop using ChatGPT, Copilot, Gemini or other artificial intelligence tools.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first step is much simpler \u2014 and much more important: <strong>knowing what AI the company is actually using and for what purpose<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In many organisations, AI is already being used without a formal inventory. An employee may use a generative AI tool to draft emails, analyse documents, translate texts or prepare reports without the company having previously assessed the associated risks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, we recommend starting with five questions:<\/p>\n\n\n\n<h3 id=\"h-1-what-ai-tools-does-the-company-use\" class=\"wp-block-heading\">1. What AI tools does the company use?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It is necessary to identify both authorised tools and those that employees use on their own initiative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This initial assessment is particularly important for detecting so-called <strong>shadow AI<\/strong>: the use of artificial intelligence systems without internal authorisation or oversight.<\/p>\n\n\n\n<h3 id=\"h-2-what-is-the-ai-being-used-for\" class=\"wp-block-heading\">2. What is the AI being used for?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Using a tool to proofread a text is not the same as using it to select candidates, assess employees, make decisions about customers or analyse personal data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The AI Act establishes different obligations depending on the type of system and the risk associated with its use.<\/p>\n\n\n\n<h3 id=\"h-3-what-data-is-being-entered-into-these-tools\" class=\"wp-block-heading\">3. What data is being entered into these tools?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This raises another fundamental issue: <strong>data protection, confidentiality and trade secrets<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that an AI tool is available online does not mean that it is appropriate to enter any type of information into it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before using it, companies should ask themselves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is personal data being entered?<\/li>\n\n\n\n<li>Is confidential information being entered?<\/li>\n\n\n\n<li>Are customer, lead or employee data being shared?<\/li>\n\n\n\n<li>How does the provider process this data?<\/li>\n\n\n\n<li>Where is the data processed?<\/li>\n\n\n\n<li>Can it be used to train models?<\/li>\n\n\n\n<li>What safeguards does the provider offer?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, <strong>compliance with the AI Act does not replace compliance with the GDPR<\/strong>. Both regulatory frameworks may apply simultaneously.<\/p>\n\n\n\n<h3 id=\"h-4-does-the-company-have-an-internal-ai-use-policy\" class=\"wp-block-heading\">4. Does the company have an internal AI use policy?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A company that allows the use of AI without establishing basic rules is taking unnecessary risks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An internal policy can determine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>which tools are authorised;<\/li>\n\n\n\n<li>what data may be entered;<\/li>\n\n\n\n<li>which uses are prohibited;<\/li>\n\n\n\n<li>when human oversight is mandatory;<\/li>\n\n\n\n<li>who may use AI systems;<\/li>\n\n\n\n<li>how outputs must be verified;<\/li>\n\n\n\n<li>what to do in the event of an incident;<\/li>\n\n\n\n<li>and what responsibilities apply to employees and different departments.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In this regard, you can consult our article on the <a href=\"https:\/\/www.rosello-mallol.com\/en\/ai-usage-policy\/\">AI Use Policy<\/a>.<\/p>\n\n\n\n<h3 id=\"h-5-does-the-company-know-what-role-it-plays-in-relation-to-the-ai-system\" class=\"wp-block-heading\">5. Does the company know what role it plays in relation to the AI system?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Not all companies have the same role under the Regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to determine whether the company acts as a <strong>provider, deployer, distributor, importer or user<\/strong> of an AI system, as the applicable obligations may vary considerably.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This assessment is particularly important for companies that develop or integrate AI solutions into their own products or services.<\/p>\n\n\n\n<h2 id=\"h-what-about-high-risk-ai-systems\" class=\"wp-block-heading\">What about high-risk AI systems?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">2 August 2026 does not mean that all obligations relating to every high-risk AI system necessarily start on that date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The AI Act establishes different application dates depending on the type of system and the legal framework applicable to it. In particular, certain AI systems integrated into products regulated by EU legislation are subject to specific later deadlines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, <strong>it is not enough to ask whether a company uses AI<\/strong>.
