{"id":17877,"date":"2022-04-01T10:00:00","date_gmt":"2022-04-01T09:00:00","guid":{"rendered":"https:\/\/www.rosello-mallol.com\/?p=17877"},"modified":"2022-04-01T10:38:10","modified_gmt":"2022-04-01T09:38:10","slug":"laws-ecommerce-must-comply","status":"publish","type":"post","link":"https:\/\/www.rosello-mallol.com\/en\/laws-ecommerce-must-comply\/","title":{"rendered":"Laws with which an ecommerce must comply"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">If you have dared to launch your online store, you may be wondering <strong>which laws an ecommerce must comply with<\/strong> so that it is within current law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this post we will mention the main ones for your peace of mind, but remember that the thorough analysis of the activity of the online business and the creation of the appropriate texts will be recommended in each case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You should not be <strong>&#8220;inspired&#8221; by the legal texts of other businesses<\/strong>, even though they may initially seem like yours. Go for this:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><span style=\"text-decoration: underline;\">Three basic laws an ecommerce must comply with:<\/span><\/strong> <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Indeed, any online store must generally comply with three laws:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Law on Information Society Services and e-Commerce.<\/li><li>General Law for the Defence of Consumers and Users.<\/li><li>General Data Protection Regulation.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Compliance with these three rules practically guarantees the lawfulness of your online store and your peace of mind as an entrepreneur or businessperson, but how does each of them affect your online business?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong><a href=\"https:\/\/www.guidetobusinessinspain.com\/en\/7-legal-framework-and-tax-implications-of-e-commerce-in-spain\/7-2-6-law-34-2002-on-e-commerce-and-information-society-services\/\" target=\"_blank\" rel=\"noreferrer noopener\">Law on Information Society Services and e-Commerce<\/a><\/strong>, has several sections that are of interest to your online store, from the <span style=\"text-decoration: underline;\">minimum legal information<\/span> that the website must have on the company or freelancer managing it to the <span style=\"text-decoration: underline;\">prior information<\/span> to offer in the event of online sales or the requirements to <span style=\"text-decoration: underline;\">send commercial emails<\/span>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In any case, whether or not you sell online, you must include the identification data of your company or your own, if you are self-employed, as well as a form of contact. This is usually included in the <strong>Legal Notice<\/strong> of the website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you intend to make commercial use of the emails provided, for example in contact forms or through other means, remember that you require <strong>express consent<\/strong> or prove that the recipient is your customer (who has bought or contracted a service from you).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong><a href=\"https:\/\/www.global-regulation.com\/translation\/spain\/1445031\/royal-legislative-decree-1-2007-of-16-november%252c-approving-the-revised-text-of-the-general-law-for-the-protection-of-consumers-and-users-and-other-co.html\" target=\"_blank\" rel=\"noreferrer noopener\">General Law for the Defence of Consumers and Users is basic in B2C online businesses<\/a><\/strong>, i.e. those selling to end consumers (not to entrepreneurs), as it establishes rights for said consumers that your business must respect. We especially highlight two that we already discussed in February 2020 in <strong><a href=\"https:\/\/www.rosello-mallol.com\/en\/ecommerce-guarantee-right-of-withdrawal-differences\/\" target=\"_blank\" rel=\"noreferrer noopener\">this post<\/a><\/strong>:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) The <span style=\"text-decoration: underline;\">right of withdrawal<\/span>, which consists of the possibility for the customer to return what was purchased, without giving any explanation, within 14 days of delivery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) The <span style=\"text-decoration: underline;\">right of guarantee<\/span>, which consists of the fact that the business must guarantee that the purchased product is suitable for its normal use. <strong>This term changed<\/strong> on 1<sup>st<\/sup> January 2022 from <strong><span style=\"text-decoration: underline;\">2 to 3 years<\/span><\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These rights are usually included in the <strong>Website Purchasing Conditions<\/strong>, text that must be available and that the customer must expressly accept before completing the purchase so that it is linked to the &#8220;contract&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Public Authorities ensuring Consumer rights are respected are usually quite active in checking that online stores meet these requirements. In some cases, they usually act without prior complaints.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, the <strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/ES\/TXT\/?uri=CELEX:32016R0679\" target=\"_blank\" rel=\"noreferrer noopener\">General Data Protection Regulation<\/a><\/strong> must be highlighted, which affects any online or offline business in which personal data is collected. Undoubtedly, an online store is no exception as there are multiple data collection channels (contact form, newsletter registration, purchase forms, etc.). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This involves the need for an adequate <strong>Privacy Policy<\/strong> for your online store, in which you must include, among others, aspects such as:\u00a0<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Your contact details.<\/li><li>An indication as to what you will do with the data.<\/li><li>Notification if you will share it with third parties.<\/li><li>Information on how customers can access or delete their data.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">In many cases, you must obtain the express consent of the customers before using their data. Also remember that having a good Privacy Policy and nothing else does not mean complying with data protection regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, the <strong>Spanish Data Protection Agency<\/strong> has the power to implement penalties, which is by far the most active in terms of inspection of those that exist in all EU Member States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawfulness of your online store is therefore not a minor issue and one that you should consider carefully. Although it may seem otherwise, no two online stores are the same and this will directly affect your legal texts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you have any question about this or any
