It must be made clear, however, that apart from the regulations of each social network regarding prize draws these are also governed by the Spanish Gambling Law 13\/2011 of 27 May in terms of their tax regime. You can consult the law <a aria-label=\"aqu\u00ed (opens in a new tab)\" href=\"https:\/\/www.boe.es\/boe_catalan\/dias\/2011\/05\/28\/pdfs\/BOE-A-2011-9280-C.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p>There are two points to consider when holding a prize draw on social media:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal terms and conditions of prize draws on social media<\/h2>\n\n\n\n<p>Any prize draw on social media must include <strong>legal terms and conditions<\/strong> that are available to users at all times and include the following information:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Identification of the organiser.<\/li>\n\n\n\n<li>Start date and end date.<\/li>\n\n\n\n<li>Mechanics of the prize draw.<\/li>\n\n\n\n<li>Participation requirements.<\/li>\n\n\n\n<li>Personal data and image protection.<\/li>\n\n\n\n<li>Value, nature of the prize and selection of the winner.<\/li>\n\n\n\n<li>Responsibility of the organisation.<\/li>\n\n\n\n<li>Applicable law and jurisdiction.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Gambling Tax<\/h2>\n\n\n\n<p>Furthermore, remember that you must pay <strong>Gambling Tax<\/strong>, which accounts for 10% of the value of the prize given. Payment is made using form 685 (tax on bets and random combinations, self-assessment).<\/p>\n\n\n\n<p>However, if the prize <strong>exceeds \u20ac300<\/strong>, the withholding must be applied through personal income tax and it must be clearly stated in the legal terms and conditions of the prize draw whether this withholding is to be made by the individual \/ company holding the prize draw or by the winner of the draw.<\/p>\n\n\n\n<p>Where <strong>payment<\/strong> by any means is required from the participant in order to take part in the prize draw, remember that all prize draw regulations will apply. In this case, <strong>prior authorisation <\/strong>must be requested from the relevant Authorities.
